The petitioner was recommended for appointment as Assistant Teacher in the Upper Primary School by the West Bengal Central School Service Commission. As the petitioner was serving as Lab Attendant at that point of time, he did not act in terms of the said recommendation. The service of the petitioner as Lab Attendant has stood nullified by the order of the Hon'ble Supreme Court. The petitioner intends to join the service as Assistant Teacher in the Upper Primary level.

Learned advocate representing the Commission submits, upon instruction that, the petitioner does not fall within the list of tainted

candidates.

The time period mentioned in the recommendation letter is, however, long over. 3.

Upon hearing the submissions made on behalf of both the parties and considering the fact that the petitioner has lost his job for no fault of his own, accordingly, the Court is minded to allow the prayer of the petitioner seeking extension of time of the recommendation letter.

The Commission is directed to recommend the petitioner to any other school with matching vacancy only after the Commission concludes the process of recruitment in respect of 1242 teachers whose appointment the Commission is considering pursuant to the order passed by the Court.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
