04/11/2025 D/L - 29 Court No.28 S. Kundu C.R.M.(A) 3265 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023.

In the matter of: Taslim Ansary

...Petitioner.

Mr. Pawan Kr. Gupta Mr. Nikhil Kr. Gupta Mr. Santanu Sett Ms. Laboni Bar ...for the petitioner.

Mr. Amajit De ...for the CBI.

1. Report filed on behalf of the CBI is taken on record. Copy of the same is handed over to the petitioner.

2. Learned counsel appearing on behalf of the petitioner submits that the petitioner is in no way connected with the alleged offence. However, he was subsequently appointed as Director of the Company in question. The Investigating Officer is threatening him to bring the main accused in or else he would be falsely implicated in this case. The petitioner has no control over the said accused.

3. Learned counsel appearing for the CBI opposes the prayer for anticipatory bail and he submits that the petitioner is not an accused in this case. He is neither named in the FIR nor in the charge-sheet. As such, the application for anticipatory bail is not maintainable.

4. It appears that the petitioner is not an accused in the instant case.

5. Therefore, the application for anticipatory bail is disposed of as not maintainable.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
