Learned Counsel appearing for the petitioner submits he is in custody for 347 days.

Learned Counsel appearing for the State opposes the prayer for bail and submits offending weapon was recovered on the leading statement of the petitioner. She further submits there were telephonic conversations between the petitioner and the deceased prior to the incident.

We have considered the materials on record.

Incriminating articles were seized from the possession of the petitioner. There were telephonic conversations between the petitioner and the deceased prior to the incident. Keeping in mind the aforesaid incriminating circumstances, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected. We are informed date has been fixed for consideration of charge.

Trial court is requested to consider the framing of charge on the next date fixed and if he is unable to do so, positively within a period of two months thereof and in the event charge is framed to take the proceedings to its logical conclusion without granting any unnecessary adjournment to either of the parties.
