The report filed by the learned Chief Judge, City Sessions Court, Bichar Bhawan, Calcutta dated 06.07.2023 along with the report of the Metropolitan Magistrate, 21st Court, Calcutta (In-Charge) dated 03.07.2023 be kept on record. None appears for the parties.

The instant revisional application was filed against an order dated 27.07.2005 passed by the learned Metropolitan Magistrate, 14th Court, Calcutta in Case No. C/175 of 1985 allowing an application dated 16th July, 2005 filed by the prosecution for the purpose of impounding the petitioners' passport.

Vide order dated 16.11.2005 passed by this Court, the order dated 27.07.2005 was modified to the extent that the present petitioners without the leave of the Court could not part with the passports in the manner as directed by the trial court. The further proceedings of the aforesaid case to continue in accordance with law. The trial court is directed to proceed with the trial of the aforesaid case in order to frame charge and take necessary measures to ensure the presence of the accused persons before the Court in accordance with law. Accordingly, the instant revisional application is dismissed.

A copy of this order be sent down at once to the learned trial court for necessary information.
