Learned counsel for the CESC Limited files a report and submits that the CESC Limited has found it feasible to give new electricity connection to the petitioner, of course, subject to compliance of formalities by the petitioner.

Upon hearing learned counsel for the parties, who are present today, it transpires that there cannot be any impediment in the CESC Limited giving an electricity connection to the petitioner from the existing meter board position.

Hence, WPA No. 21831 of 2022 is disposed of by directing the CESC Limited to give a new electricity connection to the petitioner as per the petitioner's

application, subject to compliance of all formalities by the petitioner in that regard, from the existing meter board position at the premises-in-question, preferably within a fortnight from the date of compliance of such formalities.

In the event any obstruction is raised from any quarter including the private respondent no.3 and/or his men and agents, it will be open to the CESC personnel to approach the Officer-in-Charge, Park Street Police Station (respondent no.4 herein) for necessary police assistance in that regard. If so approached, the respondent no.4 shall grant such assistance to the CESC personnel at the cost of the petitioner, acting upon a server copy of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
