1. Present petition has been filed challenging the order dated 20th July, 2023 passed by learned Civil Judge, Junior Division, 1st Court at Paschim Medinipur whereby the learned Trial Court allowed the injunction application in favour of the petitioner/plaintiff however, declined the request for police help.

2. Learned counsel submits that the order of the learned Trial Court is illegal and is liable to be set aside.

3. Learned counsel submits that without police help petitioner who is the owner of the premises could not be able to raise construction.

4. The submission of the learned counsel for the petitioner is needed to be rejected outrightly. Learned Trial Court has granted injunction in favour of the petitioner/plaintiff. The suit is still

pending disposal. There is no complaint or pleadings regarding any alleged violation of the injunction order.

5. Learned Trial Court has rightly refused the prayer for grant of police help.

6. This Court do not find any illegality or infirmity.

7. Hence this petition is dismissed.

8. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.. (Dinesh Kumar Sharma, J.)
