We are told that the appellant has not been sent up. Therefore, he has to be released from judicial custody. 3.

Learned Senior Advocate for the appellant says that the appellant has still not been released due to the pendency of this bail application.

We dispose of this bail application so that the appellant may be released, if not wanted in any other case. 5.

Learned Advocate for the victim says that this order should be subject to the victim's right to file a naraji/ protest petition. If the victim has such right in law, he can always exercise it.
