sg Ct. 8 The appellant is not represented nor any accommodation is prayed for on behalf of the appellant. The appellant was also not represented on the earlier occasion. This appeal has continuously been appearing in the list from 9th September, 2022. A decree of affirmation in a money suit is the subject matter of the second appeal.

The suit is based on an agreement dated 4th May, 1995 where the loan transaction between the parties was admitted. The plaintiffs, upon proving the agreement and acknowledgment of the loan and the factum of non-payment of the loan amount, obtained a decree from the Trail Court.

The Appellate Court, on the basis of oral and documentary evidence and more particularly, in view of the acknowledgment of such debt being proved in accordance with law, affirmed the decree.

These clear findings of facts are not required to be interfered with in a second appeal. No substantial question of law is involved in this second appeal.

The second appeal is, accordingly, dismissed. (Uday Kumar, J.) (Soumen Sen, J.)
