Criminal Revisional Jurisdiction 24-11-2022 Subha Item 122 Ct no.34 CRR 3601 of 2022 Md. Jawad -versus- The State of \W.B & Anr.

In Re : An application under Article 227 of the Constitution of India. Mr. Sk. Toslim Ali Ms. Saba Parveen ....for the petitioner.

Petitioner is aggrieved by the total quantum of maintenance with which he has been saddled, pursuant to the learned court deciding that the interim maintenance would be given from the date of filing of the application.

Having regard to the contentions of the petitioner, I direct that the petitioner would clear 25% of the total dues by 15th December, 2022. Another 25% of the total dues would be cleared by 20th January, 2023. Another 25% would be cleared by 15th March, 2023 and the rest of the amount by 20th May, 2023. If there is any failure, learned Magistrate would instead issuing distress warrant, issue warrant of arrest against the petitioner. So far as the main proceedings are concerned, learned Magistrate would proceed in accordance with law. With the aforesaid observations, the present revisonal application being CRR 3601 of 2022 is disposed of.
