Mr. Satadru Lahiri Mr. Safdar Azam .......For the Petitioner The petitioner is aggrieved by the fact that the proceedings under Sections 138/141 of the Negotiable Instruments Act was initiated in the year 2019 and till date the provisions of Section 251 of the Code of Criminal Procedure has not been complied with in connection with Complaint Case No. C-4401/2019. It has been informed that the case is fixed on 16th September, 2023.

Having regard to the fact that more than four years have passed since the initiation of the instance case, I direct the learned trial court to fix at least one date in the month for the purposes of the present case. Learned trial court would take steps so that by 15th October, 2023 the stage of Section 251 of the Cr. P. C. is over. From the month of November, 2023, as directed above, each month is fixed for the purposes of the trial of the case so that the same may be taken to its logical conclusion within a reasonable period of time. The records of the case reflect that the accused persons in a designed manner are delaying the proceedings. If required,

the learned trial court will impose conditions both in respect of the bail so granted or, in the alternative, modify the conditions under Section 205 of the Code of Criminal Procedure so that the day to day appearance of the accused persons is ensured for not deterring the progress of the trial.

With the above observations, the revisional application is disposed of.
