ct. no. 34 CRR 3042 of 2008 With IA No. CRAN 1 of 2010(Old No. CRAN 3901 of 2010) [Not Found] Asim Bhattacharya @ Asim Bhattacharjee Vs.

Regional Provident Fund Commissioner, West Bengal & Anr.

Mr. Imran Ali Ms. Debjani Sahu .....for the State The revisional application was preferred challenging the order passed by the Learned Additional Sessions Judge, 1st Fast Track Court, Serampore in connection with Criminal Motion No.64 of 2007.

None appears on behalf of the petitioner or for the State or the Provident Fund authorities.

Ms. Debjani Sahu, learned advocate who ordinarily appears for the State is directed to appear in this matter. Her appointment may be regularized by the concerned authority. Learned advocate has drawn the attention of this Court that the basic issue involved is non-payment of Provident Fund to the tune of Rs.1,112/-. The initiation of the case was related to technical issues which have been corrected by the Learned First Revisional Court in Criminal Motion No.64 of 2007.

Records of the revisional application reflects that there was no interim order after 4th March, 2009. This court has not been apprised regarding the issue of pendency of the proceedings and its outcome for the last 13 years. Having regard to the same, I am of the opinion that there is no question of interfering with the order under challenge.

Accordingly, CRR 3042 of 2008 is dismissed.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
