Heard learned advocates appearing for the parties. The petitioner has filed this writ petition being aggrieved by the alleged inaction on the part of the respondent bank in considering his representation for disclosing the details of the fixed deposit, if any, in the name of his deceased father, lying with the bank concerned. Learned advocate appearing for the bank opposes this writ petition on the ground of inordinate delay in approaching the writ Court but he does not specifically says that no fixed deposit is lying in the name of the petitioner's deceased father. Moreover, he is not in a position to say the details of any fixed deposit lying in the name of the petitioner's deceased father. He further submits that for making such claim before the respondent bank, petitioner must have to come with specific documents in respect of

proof of his claim that he is the only legal heir of his deceased father. If that is the case of the bank, it could have rejected the representation of the petitioner but being a statutory authority the respondent bank should not sit over petitioner's representation.

Considering the facts and circumstances of the case and submission of the parties, this writ petition, being WPA 21489 of 2024, is disposed of by directing the respondent bank authority concerned to consider and dispose of the aforesaid representation of the petitioner dated 28th July, 2023 by giving an opportunity of hearing to the petitioner or his authorized representative and other interested parties within a period of eight weeks from the date of communication of this order. The respondent bank shall intimate the petitioner within seven working days as to the documents required to be submitted by the petitioner for consideration of his claim made in the representation.
