His appearance may be regularized by the concerned authorities.

The grievance of the petitioner is very limited. Learned advocate for the petitioner submits that the application under Section 156(3) has been preferred in the month of June, 2023. Learned advocate for the petitioner draws the attention of the court to the order dated 11th August, 2023.

I find from the order dated 11th August, 2023 that a report has been called for from the Ballygunge Police Station. As the report did not arrive, the learned Magistrate could not pass the order. The next date has been fixed on 18th September, 2023. Mr. Ali, learned advocate for the State is to communicate to the Officer-in-charge to ensure the report being sent to the learned Chief Judicial Magistrate, Alipore on 18th September,

2023.

The Chief Judicial Magistrate, Aliproe would decide the fate of the application under Section 153 (3) of the Code of Criminal Procedure on 18th September, 2023 or within a fortnight.

With the above observations, the revisional application being CRR 3382 of 2023 is disposed of.
