The petitioner alleges that the Panchayat is in the process of setting up of a drinking water tap allegedly just in front of the shop room of the petitioner causing hindrance to her egress and ingress at the shop room. The petitioner made a representation dated August 21, 2023 at page-21 to the writ petition before the Prodhan but the same has not been considered.

In view of the above, the Prodhan shall consider the representation of the petitioner dated August 21, 2023 at page-21 to the writ petition and shall communicate its reasoned decision to the petitioner positively within a period of four weeks from the date of communication of this order.

It is made clear that this order shall not create any right or equity in favour of the petitioner if the Panchayat is of the opinion that there is no violation of any statutory provisions or rules in installing the said tap on the subject piece of land as alleged by the petitioner.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions, this writ petition, WPA 21493 of 2023 stands disposed of, without any order as to costs.
