1. The appeal is arising out of an order dated 31st August, 2023 by which the learned Single Judge refused to pass any adinterim order and has passed direction for filing affidavit.

2. We have been informed by Dr. Patra that this matter is also appearing before the learned Single Judge today. Dr. Patra submits that identical issues are under consideration before the learned Single Judge. He has further submitted that the petitioners are also not otherwise eligible.

3. In any event, having regard to the fact that the matter is listed before the learned Single Judge and there is a direction for filing affidavit, we do not find any reason to pass any interim order at this stage.

4. It is needless to mention that in the event the writ petition is allowed, the School Service Commission shall accept the application by extending the time for uploading in the portal in terms of the notification dated 11th August, 2023.

5. With the aforesaid observation, the appeal and the application stand disposed of.

6. However, there shall be no order as to costs.

7. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
