Versus

Mst. Johara Khatun sg Ct. 8 In view of the failure to file the certified copy of the decree of the appellate court, the Additional Stamp Reporter in its order dated 17th July, 2007 reported that it is not possible to give any report as to whether the second appeal has been filed during the period of limitation. There are other defects as well pointed out by the Additional Stamp Reporter.

The matter was earlier taken up for consideration on 28th March, 2008 and when, upon noticing the defects, the coordinate Bench directed the matter to go out of list with liberty to mention after removal of defects. No attempt was made to remove the defects.

Under such circumstances, the second appeal stands dismissed as time barred.
