Petitioner is aggrieved by the fact that in spite of several representations being furnished with the Baruipur Police Station, no steps have been taken. State has submitted a report which reflects that Baruipur P.S. Case No. 1798 of 2025 dated 17.09.2025 has been registered for investigation particularly, with regard to the allegations of private respondents along with other unknown miscreants forcefully entering into the mortgaged property and trying to change the nature and character of the property including assaulting the security guards of the said property.

maintainability of the writ petition and submits that Bombay High Court is in seisin of the issue. Be that as it may, since this Court is only concerned about any police action or overaction and report of the State reflects that a case has already been registered in respect of the information so furnished, I am of the opinion that the State in such circumstances would take the investigation of the case to its logical conclusion. So far as the other issues are concerned, the appropriate forum would adjudicate on the same, if there has been any violation of the civil consequences so far as the property is concerned. Since the police case has been registered, police would ensure that there is no violation of law and order.

With the aforesaid observations, the writ petition being WPA 21772 of 2025 is disposed of. There will be no order as to costs.
