Mr. Indrajit Roy Chowdhury Mr. A.G. Kar ......for the petitioner Affidavit of service filed on behalf of the petitioner in terms of previous order dated 24th June, 2024 is taken on record.

Though notice was served upon school authorities of Dawarka High School, Birbhum being respondent nos. 4 to 7, those respondents are not represented today.

Grievance of petitioner is failure on the part of the school authorities to sanction leave which was availed of by petitioner starting from the year 2012 intermittently on medical ground. During course of hearing, notice of this Court has been drawn to a memo dated 8th March, 2021 issued by the District Inspector of Schools (SE), Birbhum wherein petitioner was advised to approach the school authority for redressal of grievance. It has been submitted by the learned advocate representing the petitioner

that till date no formal decision has been taken by the Managing Committee of the school on the prayer for leave of the petitioner. It is also submitted that petitioner has not been allowed by the aforesaid school authority to resume her duty since leave has not been sanctioned.

Taking note of the memo dated 8th March, 2021 issued by the District Inspector of Schools (SE), Birbhum advising the petitioner to approach the school authority for settling the issue relating to leave, leave is granted to petitioner to make a composite application for sanction of leave to the Headmaster/ Teacherin-Charge of aforesaid school being the respondent no. 7 by fortnight from date. If such leave application is made within the aforesaid time, the Managing Committee of Dawarka High School is directed to take decision on such leave application by eight weeks from the date of receipt of leave application, if no decision has been taken by the said Managing Committee in the meantime.

Accordingly, the writ petition stands disposed of.

There shall be, however, no order as to costs.
