The grievance of the petitioner in the present writ application is that initially the Executive Engineer, P.W.D., Birbhum Electrical Division, Suri, Birbhum has issued the provisional work order on March 18, 2021 and subsequently, on October 17, 2021 the work order was regularized and the petitioner has completed the work and on completion of the work, on February 9, 2024, the Executive Engineer, P.W.D., Birbhum Electrical Division, Suri, Birbhum has issued a certificate certifying that the work assigned to the petitioner has been completed. After the completion of the work, the petitioner has submitted the bill but no amount has been released. Subsequently, the petitioner has made several representations and the representations are still pending before the authority. 2.

The learned counsel for the petitioner submitted that petitioner will be satisfied if the writ petition is disposed of by directing the authority for consideration of the representation filed by the petitioner for release of the amount. He further submits that after receipt of

the bill submitted by the petitioner part payment has been made and further amount is due.

The learned counsel for the State/respondent submits that the petitioner has filed the representation and is pending before the authority, if a direction is passed, the authority shall consider the same.

In view of the submission made by the learned counsel for the respective parties, WPA 21783 of 2025 is disposed of by directing the respondent no. 8 i.e., the Executive Engineer, P.W.D., Birbhum Electrical Division to consider the bill submitted by the petitioner along with the representations with respect of release of the payment of the petitioner within a period of four weeks from the date of receipt of the copy of this order and if the authorities found that the petitioner is entitled to get the payment, the payment shall be released within a period of two weeks and in case, the respondents find that the petitioner is not entitled to get the payment, the respondents shall pass a reasoned and speaking order.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
