Petitioner contends that the allegations do not disclose ingredients of cognizable offences.

I have considered the materials on record. Petitioners are the son and daughter-in-law respectively of the opposite party No.2/complainant. In the complaint opposite party No.2 has alleged that she is a cardiac patient. Petitioner No.1 and his wife, that is, petitioner No.2 had held out threats at her. On 07/02/2024 they came to their residence and abused her in a threatening manner. They even poured kerosene oil with bad intention. Opposite party No.2 apprehends threat to her life and security. These uncontroverted allegations inter alia make out a case under Section 23 of the Senior Citizen Act.

Credibility of the allegations are subject matter of the investigation and interference in the proceeding would amount to prejudging them.

Hence I am not inclined to entertain the petition. It is open to the petitioners to agitate their defences in the event the investigation results in the filing of a police report against them.

With the observation the application being CRR 3753 of 2024 is disposed of.
