1. Petitioner was the applicant before the Tribunal. his O.A. No. 701 of 2023 for the relief in respect of compassionate appointment was rejected by the West Bengal Administrative Tribunal by an order dated 07.08.2025, which is the subject matter of the present writ petition.

2. Affidavit of service filed by the petitioner is taken on record.

3. The petitioner's application for compassionate appointment was rejected by the authorities finding him ineligible on the ground of not possessing the requisite educational qualification (VIII pass).

4. The learned advocate for the writ petitioner submits that the petitioner is a 5th pass, and claiming relaxation, without relying upon the certificate issued by the Delhi Board of Secondary and Senior Education also he can be appointed. He submits that

he will be making an application for relaxation in the educational qualifications.

5. Without expressing any opinion on the merits of such submission, as the issue, if raised, is to be considered by the authorities in accordance with law. We dispose of the writ petition with liberty to the petitioner to make such application.

6. Urgent Photostat Certified copy of this order, if applied for, be supplied to the parties upon compliance with all necessary formalities.
