1. The alleged contemnor is personally present in Court.

2. It is submitted on behalf of the alleged contemnor that the criminal proceeding pending between the parties and the family members of the respondent has not been withdrawn.

3. The learned Counsel for the petitioner submits that the petitioner shall not pursue the criminal proceeding and it would be open for the respondent to pray for quashing of the criminal charges on the basis of the decree to be passed in the proceeding pending before the learned District Judge, Barasat and the petitioner shall not oppose such prayer.

4. On an undertaking given by the alleged contemnor that he shall sign the application for mutual divorce within one week from date, the contempt proceeding is dropped.

5. In the event the application is filed for mutual divorcee, we request the learned District Judge, Barasat, North 24 Parganas to dispose of the said application following our order dated 10th August, 2023 as expeditiously as possible. (Uday Kumar, J.) (Soumen Sen, J.)
