It appears from the record that an application under Order 1 Rule 10(2) of the Code of Civil Procedure, 1908 was fixed for hearing on August 23, 2023.

Learned advocate appearing for the petitioner submits that such application has been allowed sometimes in the month of September,2023.

Since the suit is pending from the year 2018, CO 3101 of 2023 is disposed of by requesting the learned Civil Judge, Junior Division, 1st Court, Howrah to make all endeavours to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
