Mr. Amitabha Ghosh .......For the Petitioner Mr. Santanu Deb Roy ....For the State The petitioner is directed to serve a copy of this revisional application upon Mr. Santanu Deb Roy, learned advocate who ordinarily appears on behalf of the State. His appearance may be regularized by the concerned authorities.

The petitioner is aggrieved by the factum of warrant of arrest issued by the learned Chief Judicial Magistrate, Dakshin Dinajpur, Balurghat in connection with G. R. Case No. 1471 of 2022 corresponding to Balurght P. S. Case No. 521 of 2022 dated 23.07.2022.

Learned advocate appearing for the petitioner submits that the petitioner intends to surrender before the learned Chief Judicial Magistrate, Dakshin Dinajpur. In case the petitioner appears before the learned Chief Judicial Magistrate, Dakshin Dinajpur and prays for bail, learned court would decide the application for bail in accordance with law. The execution of warrant of arrest is stayed till 30th of September, 2023, subject to the condition that the petitioner shall meet with the Inspector-in-

charge or Officer-in-charge and officer of the case related to Balurghat Police Station once a week till 30th September, 2023. In case the petitioner does not surrender by 30th September, 2023, the learned Chief Judicial Magistrate, Dakshin Dinajpur on 3rd October, 2023 will shift and proceed to Section 82 of the Code of Criminal Procedure.

With the above observations, the revisional application is disposed of.
