Banerjee) Mr. Dinendra Nath Chatterjee ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff and is directed against order no. 53 dated March 28, 2025 passed by the learned Civil Judge (Jr. Division), 1st Court at Ranaghat. By the order impugned the application under Section 7(2) of the West Bengal Premises Tenancy Act, stood disposed of.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that the defendants/opposite parties are defaulter in payment of rent since November 30, 1991.

The learned trial judge after considering the material on record arrived at a finding that the rent was due from the month of Ashwin, 1427 B.S. to Agrahayan, 1427 B.S. The learned trial judge took note of the order-sheet of the Rent Control Case No. 6R/2007-08 and directed the defendants/opposite

parties to pay the arrear rent for the month of Ashwin, 1427 B.S. to Agrahayan, 1427 B.S. together with interest at the rate of 10% per annum.

Learned advocate appearing for the petitioner could not demonstrate that there is any infirmity in such finding of fact.

For such reason this court is not inclined to interfere with the order impugned.

Accordingly, CO 3374 of 2025 stands disposed of.
