It appears from the record that hearing of the application under Order 1 Rule 10 of the Civil Procedure Code, 1908 was fixed on August 23, 2023. Learned advocate for the petitioner submits that the said application has been allowed by the learned trial Judge sometimes in the month of September 2023. In that view of the matter, CO 3013 of 2023 is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court, Howrah to dispose of the Title Suit No.509 of 2018 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
