1. The parties represented through their respective learned counsels.

Since, the Additional Government Pleader usually appears for the State, let his appearance be regularized along with other learned Counsels who have been engaged in this matter.

2. The petitioners are the lawful operators in the restricted field by plying their respective vehicles on the routes mainly Madhyamgram to Memari extended up to Monteswar and allied routes Maldanga to Memari under the permits issued by the Regional Transport Authority, Purba Burdwan.

3. Main grievance of the petitioner is against illegal and unauthorized plying of vehicle of the respondent no. 5 beyond the permitted route overlapping the bus route violating the conditions of the permit and the guidelines of the authority concerned. The petitioners

already have made a representation on 19.07.2024 before the respondent no.

received on 22.07.2024 but the same is still pending for consideration.

4. Having heard the parties and upon perusing the available records I direct the respondent no. to consider the representation dated 19.07.2024 being annexure p-3 to the writ petition at page 21 within a period of 8 weeks and shall pass a reasoned order in accordance with law upon affording an opportunity of hearing to all the interested parties. The said order shall be communicated to the interested parties within a week thereafter.

5. The writ petition is disposed of without taking any exception to the merits of the case.

6. However, it is needless to mention that the respondent no. 2 shall consider and arrive at a logical stand and take necessary steps forthwith in accordance with law.
