The petitioners participated in a recruitment process for filling up the vacant sanctioned posts of Mazdoor in the English Bazar Municipality.
The Chairman, English Bazar Municipality has passed an order in compliance of the direction passed by this Court in WPA 2325 of 2022 and has come to a finding that the writ petitioners have been selected in their respective categories.
The merit list was prepared by the Recruitment Board and forwarded to the Director of Local Bodies for approval vide Memo No. 1199/II.13/22.23 dated July 15, 2022. The said list is pending approval before the Director of Local Bodies till date.
Learned advocate representing the Municipality admits that the merit list along with supporting
documents was forwarded to the Director of Local Bodies.
Learned advocate representing the Director of Local Bodies submits that necessary direction may be passed in the matter.
As it appears that the documents have already been forwarded by the English Bazar Municipality to the Director of Local Bodies and the same is pending approval for a considerable period of time, accordingly, the Director of Local Bodies being the respondent no. 3 herein is directed to take steps to consider the documents forwarded by the Municipality in accordance with law at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order.
In the event, the Director of Local Bodies is of the opinion that the panel in question may be approved, then, the said respondent shall take necessary consequential steps in the matter.
The fate of the consideration shall be communicated to the petitioners immediately thereafter. The writ petition stands disposed of.
Affidavit-of-service filed in Court today is taken on record.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
