28.09.2022 sdas rejected C.R.M.(NDPS) No. 1102 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Berhampore Police Station Case No. 1258 of 2021 dated 29.10.2021 under Section 21(c) of the NDPS Act.

And In Re : Milon Sk. & Anr. .... petitioners Mr. Kallol Mondal Mr. Monirzzaman ....for the petitioners Mr. Sudip Ghosh Mr. Bitasok Banerjee ...... for the State Having considered the materials on record prima facie disclosing involvement of the petitioners in dealing in narcotic substance above commercial quantity i.e. 5000 bottles of Phensedyl and in view of statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected.
