1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner is aggrieved by incorporation of his name in the list containing names of tainted candidates which was published vide memo dated 30th August, 2025 featuring names of 1804 number of candidates. According to the petitioner, he should not be treated as tainted candidate in connection with 1st State Level Selection Test, 2016 for Classes IX-X and XIXII.

3. Issue is no more res integra. This Court has decided the issue vide judgment dated 2nd September, 2025 delivered on a batch of writ petitions, first one being WPA 20845 of 2025 (Sampa Ghosh Vs. State of West Bengal &

Ors.). Judgment dated 2nd September, 2025 delivered in Sampa Ghosh (supra) was assailed before the Hon'ble Division Bench and the judgment of this Court was not interfered with.

4. Learned advocate representing West Bengal Central School Service Commission has placed before this Court an order dated 12th September, passed by the Hon'ble Supreme Court on a Special Leave to Appeal (C) No(s). 26212/2025 (Bikash Patra & Anr.

Vs. The West Bengal Central School Service Commission & Ors.). In the aforesaid Special Leave Petition judgment of this Court dated 2nd September, 2025 was questioned and Special Leave Petition was dismissed by the Hon'ble Supreme Court vide order dated 12th September, 2025.

5. In view of aforesaid situation, this Court finds no merit in the writ petition and same stands dismissed.

6. However, there shall be no order as to costs.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
