Learned advocate appearing for the petitioners submits that 15 bottles of Phensedyl/cough syrup was recovered from the principal accused and the petitioners have been implicated in connection with the instant case on the basis of the statement of the said accused. The petitioner no. 1 is in custody for 208 days and the petitioner no. 2 is in custody for 204 days. It has been submitted that chargesheet has already been submitted, therefore further detention of the petitioners are unwarranted. Learned advocate for the State opposes the prayer for bail.

Records reveal that the petitioners were implicated on the basis of the statement of the principal accused.

Considering the same, I am of the view that further detention of the petitioners are unwarranted. Accordingly, the petitioners viz. 1. Sanjit Mandal @ Sanjit Mondal and 2. Pandab Mandal shall be released on bail upon furnishing bond of Rs. 20,000/- each, with two sureties of Rs. 10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court cum Additional Sessions Judge, 3rd Court, Malda.

If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the District of Malda without the prior permission of the learned Special Court. The application for bail, being C.R.M. (NDPS) 1135 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
