This Court has considered the opposition filed by the DPPG and the DI of Schools and the replies filed by the petitioner thereto.

It is demonstrated from the opposition of the State that the petitioner has been paid and issued PPO, at par with the emoluments paid to the other teacher under the DPSC concerned. This has happened since after the schools under the Asansol Municipal Corporation were taken over by the DPSC.

It further appears that the petitioner's pay scale and the PPO has been fixed in terms of the ROPA 1998.

Learned counsel for the DI points out two orders passed by the Co-ordinate benches of this Court that they approved the aforesaid pay fixation in WP 34963 (W) of 2013 by order dated 12th June, 2014.

The petitioner, however, insists that one Dipali Banerjee, has received higher pay scale despite being similarly situated like the petitioner and another teacher called Md. Ghulam Rabbani. The particulars of the date of joining and the date of retirement of the said Dipali Banerjee are not available before this Court.

In view of the aforesaid, this Court finds no contempt on the part of the respondents.

Hence, the instant contempt application shall stand disposed of.

Rule, if any, shall stand discharged.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
