The father of the petitioner was an Assistant Teacher of Manickpur Free Primary School under Sonarpur West Circle of the District Primary School Council (DPSC), 24-Parganas (South).

The concerned teacher, on attaining the age of superannuation, had retired from his service on March 31, 1994 and had died on September 11, 2009, his widow, who was receiving family pension, had also died on May 27, 2018.

The prayer of the petitioner for family pension is pending at the end of the District Inspector of Schools (P.E.), District: 24-Parganas (South), the respondent no.3 herein.

The said respondent, by his letter dated March 15, 2024 has asked the Sub-Inspector of Schools, Sonarpur Circle, the respondent no.4 herein to prepare the pension papers of the

petitioner and send the same along with the documents mentioned therein.

The petitioner is alleging that the respondent no.4 is delaying the preparation of the pension papers.

It appears from the said letter dated March 15, 2024 that the said documents are necessary to prepare the pension papers of the petitioner. Learned Advocate for the petitioner submits that except the service book and the pension book in duplicate, his client shall submit the other documents with the respondent no. 4 immediately. The petitioner is directed to submit the said documents within a week from date, and the respondent no.4, within two weeks from the date of receipt of the said documents, shall send the pension papers of the petitioner to the respondent no. 3.

The respondent no. 3, on receipt of the said documents, shall consider the prayer of the petitioner in accordance with law and if it is found that she is eligible to such family pension, shall take forward steps and shall send the said pension papers to the Director of Pension, Provident Fund and Group Insurance (DPPG), the respondent no.2 herein for issuance Pension Payment Order in favour of the petitioner in accordance with law, expeditiously.

WPA 22149 of 2024 is disposed of with the above terms without any order as to costs.
