The instant criminal revisional application is pending since 2011 and as such, required to be disposed of. None appears for the petitioner though the learned advocate for the State is present.

The instant revisional application has been filed for quashing of the proceeding being Bowbazar Police Station Case No.359 of 2010 dated 26th June, 2010 corresponding to G.R. Case No.2301 of 2010 under Sections 120B/406/420 of the Indian Penal Code.

The report submitted by the learned 3rd Metropolitan Magistrate, Calcutta dated 21st August, 2023 stated that the charge in the aforesaid G.R. Case was framed on 10th May, 2012 and examination-in-chief of the PW 1 was recorded on 3rd August, 2012. The trial has commenced and there are sufficient materials on record to deal with the aforesaid G.R. Case for determination and proper adjudication. Accordingly, the instant revisional application is dismissed.

The learned trial court is directed to take necessary steps in disposing of the aforesaid G.R. Case as expeditiously as possible resorting to legal provisions in order to compel the accused persons to appear before the Court.

Copy of the order be sent to the trial court for immediate compliance.
