The report submitted by the Officer-in-Charge, Bowbazar Police Station dated 18.11.2023 stating that the opposite party No. 2 i.e. Lin Chao Hsing has expired on 10.04.2015 supported by a copy of the death certificate. Let the same be kept on record.

Perused the contentions of the revisional application as well as the impugned order it appears that the dispute between the parties are civil in nature and in order to allow to continue with the proceeding before the learned trial court will result in abuse the process of law as such the instant revisional application is allowed.

Under such circumstances, the proceeding being Bowbazar Police Station F.I.R. No. 359 of 2010 dated 26.06.2010 corresponding to G.R. No. 2301 of 2010 under Section 120B/406/420 of the Indian Penal Code is quashed.

Copy of the order be sent to the Department and learned trial Court for information.
