Petitioner submits on selfsame allegation he had been prosecuted and acquitted. Subsequently the present case has been registered.

In view of the aforesaid submission I direct copy of the petition be served upon the opposite party No.1 through public prosecutor, opposite party No.2 through registered speed post with Acknowledge Due.

There shall be stay of proceeding being GR Case No.2299 of 2024 arising out of Chinsurah Police Station Case No.287 of 2024 dated July 08, 2024 under Section 447 of the Indian Penal Code substituted by Section 329(3) BNS, 2023 and Section 3 of the West Bengal Land Reforms Act, 1955, now pending before the court of Learned Chief Judicial Magistrate, Hooghly Sadar at Chinsurah for six weeks or until further orders, whichever is earlier.

The matter will appear in the list under the heading Contested Application.

Liberty to pray for extension, for vacating/modification upon notice to the opposite party.
