Fatema Bibi v. The State Of West Bengal And ORS
05.03.2025 Court No.26 S.D.
CRM (DB) 2927 of 2024 In re: An Application for cancellation of bail under Section 483 (3) of Bharatiya Nagarik Suraksha Sanhita, 2023/under Section 439
(2) of the Code of Criminal Procedure.
-AndIn the matter of: Fatema Bibi ... ... Petitioner Md. Mansoor Alam ...For the Petitioner Md. Y. Mondal ...For the O.P. Nos. 2 to 4 Mr. Prasun Kumar Dutta Mr. Debanshu Ghorai ...For the State Application is for cancellation of the order dated June 10, 2024 passed by the learned Additional Chief Judicial Magistrate, Baruipur, South 24-Parganas.
Perversity of the order is the ground canvassed for cancellation.
State and the private opposite parties are represented. We perused the materials in the case diary.
Injury report suggests simple hurt being suffered. There is hardly any material corroborating the claim of molestation.
Learned Jurisdictional Court proceeded to grant bail on the ground of compliance with Section 41A Notice of the
Cr.P.C. and the voluntary surrender by the private opposite parties.
We do not find any requirement to interfere with the order passed granting bail to the private opposite parties. C.R.M. (DB) 2927 of 2024 stands dismissed.
