Ct.No.7.

as C.R.R. 2858 of 2012 In the matter of : Ibu Sam @ Ilu Sam.

.... Petitioner.

Mr. Dipanjan Dutt, Mr. Paritosh Sinha, Mr. Amitava Mitra, Ms. Urmi Sengupta.

...for the Petitioner.

Mr. Amitava Mitra.

...for the Opp. Party.

1.

During the course of the hearing, Mr. Dutt, learned Advocate representing the petitioner, informed the Court that the complainant has expired.

2.

Record reveals that this Court called for a report from the concerned police station, which has confirmed that the complainant expired on 10th January, 2019.

3.

Mr. Dutt has further pointed out that by passing an interim order in this application, all proceedings in complaint case C/14140 of 2011 under Sections 420/120B/34 of the Indian Penal Code have been stayed. He is unable to inform the Court whether the fact of the complainant's demise was brought to the notice of the learned Court below.

4.

In view of the subsequent development, namely, the death of the complainant, the present revisional application stands disposed of, with liberty reserved to the petitioner to bring this fact to the notice of the learned Court below and to make an appropriate application before the said Court.

5.

To avoid any confusion and to enable the learned Court below to pass appropriate orders on the application to be filed by the petitioner, it is clarified that the interim order earlier passed in this matter stands vacated.
