1. On consent of the parties, the appeal is disposed of in the following manner.

2. By an earlier order passed in WPA 23564 of 2022 the Secretary, Food and Supplies Department or any competent officer appointed by him was directed to consider the representation of the petitioner and after hearing the parties, to decide the same within four weeks from the date of communication of the order.

3. The Secretary concerned deputed the Director to conduct the hearing and decide the matter but the director delegated the hearing to Deputy Director, Law and Deputy Director DDP&S and decided the matter on the basis of a report filed by them.

4. In view of the departure from the direction in WPA 23564 of 2022 with regard to the decision making process both the parties agreed that the matter to be decided afresh by the Director DDP&S who shall,

after hearing the parties, pass a reasoned order disposing of the representation of the appellant. The entire exercise shall be completed within eight weeks from date and the reasoned order shall be communicated to the parties one week thereafter.

5. We express no opinion on the merits of the case which is kept open to be decided by the Director independently and in accordance with law.
