Mr. Prabir Majumder Mr. Dipanjan Chatterjee Ms. Kakan Das Ms. Rimpa Adhikary ...for the Petitioner Mr. Bibhaswan Bhattacharya Ms. Sana Nazz ...for the State Learned counsel appearing on behalf of the petitioner submits that on 16th December, 2024 an auto was intercepted wherefrom three persons were arrested and 1000 bottles of cough syrup containing codeine phosphate was recovered. One of those three accused persons took the name of the present petitioner.

The petitioner preferred an anticipatory bail prayer before this High Court which was rejected on 23rd July, 2025 and thereafter on 28th July, 2025 he voluntarily surrendered before the court and since then he is in custody. He further submits that the investigation has already been culminated into a charge-sheet and as such he may be released on bail on any terms and conditions.

charge-sheet and he further submits that the petitioner has made several phone calls to the co-accused persons and from the statement of co-accused persons involvement of the present petitioner clearly established during investigation. Having heard learned counsel appearing on behalf of the petitioner and the State and on perusal of the materials placed before me, which are available in the case diary, I find that prima facie there are sufficient reason to believe petitioner's involvement with the alleged offence, as such restrictions imposed under section 37 of the NDPS Act, clearly attracts in respect of the present petitioner. Considering the same, the prayer for bail made by the petitioner is considered and rejected.

Accordingly, CRM (NDPS) 1137 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
