Mr. Arijit Ganguly, Mr. Sanjib Dan, .....For the State This revisional application was preferred against the order dated 10.4.2012 passed by the Learned Additional Chief Judicial Magistrate, Sealdah in case no. C-229 of 2012 under Section 156(3) of the Code of Criminal Procedure.

The record reflects that the Learned Magistrate after being satisfied regarding the contentions advanced therein was pleased to direct the police authorities to register the case and consequently directed the concerned Officer-in-charge to start investigation. As none appears on the behalf of the State Mr. Sanjib Dan, learned advocate who usually appears on behalf of the State, is directed to appear in this matter. His appointment may be regularized by the concerned authorities.

The revisional application appeared on 27.8.2021 and there was no interim order restraining the proceedings. Having regard to the fact that the FIR was registered and the same has not been challenged, I do not find at this belated stage, it will be fit and proper to pass any order which will prejudice the proceedings or the report under Section 173 of the Cr. P.C.

Accordingly, CRR 2863 of 2012 is dismissed.

Interim order, if any, stands vacated.

All pending connected applications, if any, are consequently disposed of.
