It appears from record that against the grievance raised in this writ petition, an appeal in question is pending before the appellate authority concerned and it is the grievance of the petitioner that petitioner has not been made known about the fate of the said appeal and as such he has not been able to take further recourse against the order passed by the appellate authority, if any, adverse to the interest of the petitioner.

By the order of this Court dated 5th February, 2024, Mr. Mukherjee, learned advocate representing the respondent Railway authority was asked to take appropriate instruction as to the fate of the said appeal in question and in compliance of the said direction Mr.

Mukherjee, learned advocate

representing the respondent Railway authority submits written instruction, on perusal of which it appears that the appeal in question has already been disposed of and it has been sent by Post to the petitioner and a copy of the order of the appeal has been handed over to Mr. Bhattacharjee, learned senior advocate who has accepted the same on behalf of the petitioner.

If petitioner is aggrieved by such order of the appellate authority he shall be free to take further recourse in accordance with law before the appropriate forum.

Written instruction with supporting documents filed by learned advocate representing the respondent be kept with the record.

With this observation this writ petition being WPA 21549 of 2023 stands disposed of.
