Petitioner has approached this Court as he has set the law into motion in connection with Basirhat P.S. Case No.283 of 2025 dated 06.04.2025. The sections which have been incorporated in the First Information Report which is being investigated reflect that the injured was severely affected by the action of the accused persons. There are medical documents in support of the same. However, the police authorities till date could not trace out the accused persons nor the accused persons have aided the investigation of the case. The report also reflects that informations were received that the accused persons are threatening the petitioner.

Considering the same, I direct a superior officer of police to monitor the investigation of the

case and assess regarding the grievance of the petitioner particularly with regard to the threats which the petitioner is facing from the accused persons who are evading the process of law. In case the concerned superior officer of police is satisfied in respect of the complaint of the petitioner, steps be taken for providing appropriate protection to the petitioner and/or his family members who are at the receiving end after being injured and suffered severe injuries.

The case commenced in the month of April, 2025. More than five months have passed since then. Consequentially, under Section 193 of the BNSS, petitioner is entitled to have a progress report. As such, the superior officer of the case will direct the investigating officer of the case to immediately send the progress report of the case to the petitioner. In case the progress report is not to the satisfaction of the petitioner, petitioner would be at liberty to take out an appropriate application before the jurisdictional Magistrate-in-Charge of Basirhat P.S. Case No.283 of 2025. Learned Magistrate would, if he is satisfied regarding the grievance of the petitioner, address the same within the framework of law. With the aforesaid observations, WPA 21706 of 2025 is disposed of.

There will be no order as to costs.
