The petitioner retired from service of Mashaldaha Ganapatrai High School (H.S.), Malda, on 31.01.2019. After initial harassment and delay, the 'No Liability Certificate' has been issued to the petitioner and has been receiving pension. The school, however, has not released Provident Fund.

In that view of the matter, the Teacher-inCharge, Mashaldaha Ganapatrai High School (H.S.), Malda, shall take a decision on release of Provident Fund to the petitioner in accordance with law, mandatorily and positively, within a period of two months from the date of communication of a copy of this order.

With the aforesaid observations, the writ petition shall stand disposed of.

The Provident Fund payable to the petitioner, shall carry interest @6% per annum from the date retirement of the petitioner till the actual date of release.

Notice dated June 20, 2022, addressed to the respondent, be kept with the record.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
