The writ petition has been filed, inter alia, praying for appointment of the petitioner as Anganwari Worker under Child Development Project Officer, Indas, Bankura on the score that in terms of the merit position under the general category 39 candidates were engaged as Anganwari Worker but the candidate whose name featured against Serial No.5 did not join; therefore petitioner should have been appointed in the resultant vacancy. In support of such contention page 23 of the writ petition has been relied upon.

Having considered the submission made on behalf of the petitioner this Court directed the concerned Child Development Project Officer to submit a report in the form of affidavit and an affidavit was affirmed on 12th December, 2023 disclosing that the last empanelled candidate who was engaged as Anganwari Worker obtained 53.67

marks whereas petitioner obtained 41.67 marks. The list of appointed candidates as well as the panel prepared on the basis of merit position are enclosed to the report.

Having considered the report submitted on behalf of the Child Development Project Officer it is found that the petitioner obtained 41.67 marks whereas the last engaged candidate obtained 53.67 marks. Therefore, petitioner did not come within the zone of consideration for being considered to be engaged as Anganwari Worker.

Accordingly, the writ petition stands dismissed.

However, there shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
