This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track Court, 1st Court at Alipore to dispose of the Matrimonial Suit No. 899 of 2023 expeditiously.
The learned advocate appearing for the petitioner submits that the husband/petitioner herein has filed the additional written statement and a direction be passed upon the learned trial judge to dispose of the matrimonial suit expeditiously. In view of the order sought and proposed to be passed, there no necessity to direct issuance of
notice upon the opposite party. However, the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing the opposite party before the learned trial judge. From the ordersheets appended to this application this Court finds that Miscellaneous Case No. 375 of 2023 is pending.
The learned advocate appearing for the petitioner submits that the said miscellaneous case was filed by the wife/opposite party herein under Section 24 of the Hindu Marriage Act praying for alimony pendente lite.
In view thereof, C.O. 3385 of 2025 is disposed of by requesting the learned Additional District Judge, Fast Track Court, 1st Court at Alipore to make an endeavour to dispose of the Miscellaneous Case No. 375 of 2023 as expeditiously as possible without granting any unnecessary adjournments to either of the party.
After disposal of the miscellaneous case the learned trial judge shall make an endeavour to dispose of the matrimonial suit as expeditiously as possible without granting any unnecessary adjournments to either of the party.
No order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
