The petitioners contend that the respondent no. 3 being the Director of the Local Bodies, Government of West Bengal be directed to act in terms of the aforesaid notification.

The Municipality is represented and submits that they have taken all steps and they have forwarded the necessary documents to the respondent no. 3 for further processing.

I have heard the parties.

In view of the submission made by the Advocates appearing on behalf of the parties, I direct the Director of the Local Bodies being the respondent no. 3 to consider and dispose of the representation of the petitioner for post facto approval of appointment in accordance with law and following the relevant notifications within a period of two months from date.

It is needless to mention that the respondent no. 3 will not be influenced by any observation made in this

order on the merits of the case and is directed to pass a reasoned order in respect of the claim of the petitioners after giving an opportunity of hearing to all the affected parties.

With the aforesaid directions, the petition being WPA No. 20963 of 2018 is disposed of.

There will be, however, no order as to costs. (Ravi Krishan Kapur,J)
