The grievance of the petitioner is directed against non-payment of retiral dues. The petitioner relies on a notification and order appearing at page 21 of the writ petition being Annexure P-2.

The petitioner contends that the respondent no. 3 being the Director of the Local Bodies, Government of West Bengal be directed to act in terms of the aforesaid notification.

The Municipality is represented and submits that all steps have been taken as required by them and they have forwarded all the documents to the respondent no. 3 for further processing.

I have heard the parties.

In view of the submission made by the Advocates appearing on behalf of the parties, I direct the Director of the Local Bodies being the respondent no. 3 to consider and dispose the representation and claim of the petitioner in so far as the retiral dues of the petitioner are concerned,

in accordance with law and following the extant Notifications within a period of two months from date. It is needless to mention that the respondent no. 3 will not be influenced by any observation made in this order on the merits of the case and is directed to pass a reasoned order in respect of the claim of the petitioner. With the aforesaid directions, the petition being WPA No. 20965 of 2018 is disposed of.

There will be, however, no order as to costs. (Ravi Krishan Kapur,J)
