Affidavit-of-service so filed be kept with the record. Report submitted by Mr. Anwar Hossain, learned advocate appearing for the State be kept with the record. The said report has been prepared by the Assistant Commissioner of Police, South Bidhannagar, Bidhannagar Police Commissionerate in connection with Electronics Complex Police Station Case No.162 of 2022 dated 18.10.2022. The said case was registered for investigation under Sections 354A/506/509/34 of the Indian Penal Code along with the provisions of other Act.
On conclusion of investigation, charge-sheet was also
submitted before the jurisdictional court.
Learned advocate for the private opposite party no.2 is also present.
I have considered the submissions which have been enclosed along with the report submitted by the Assistant Commisssioner of Police. From the spirit of the statement, it is clear that the de facto complainant, namely, Sagarika Malakar do not intend to proceed with the present case being Electronics Complex Police Station Case No.162 of 2022 dated 18.10.2022 wherein charge-sheet was submitted. Accordingly, all further proceedings in connection with the aforesaid case pending before the learned ACJM, Bidhannagar is hereby quashed. Accordingly, CRR 3399 of 2023 along with CRAN 1 of 2023 is allowed.
Pending other applications, if any, are consequently disposed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
