Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick ...for the petitioners Ms. Sujata Das ...for the de facto Ms. Manisha Sharma Ms. Rita Dutta ..for the State Report filed on behalf of the State is taken on record. Heard the learned counsels for the parties.

It appears from the report that tower location of the phone of the petitioner no.1 showed that it was at Cooch Behar and not under the Manikchak Police Station.

There are statements of minor victim girl and eye-witnesses implicating the petitioners.

Considering the above and the other materials available in the case diary, while I am inclined to grant anticipatory bail to the petitioner no.1, the application for anticipatory bail of the petitioner nos. 2, 3 and 4 (Choton Mandal @ Tinku Mandal, Rubi Mandal @ Rabi Mandal and Paritosh Mandal) is rejected. Accordingly, the application for anticipatory bail of the petitioner no.1 is allowed.

In the event of arrest, the petitioner no.1 (Dipankar Mandal @ Krishna Mandal) shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner no.1 shall not threaten or intimidate witnesses and shall co-operate with the investigation. The petitioner no.1 shall meet the I.O. once a fortnight till submission of report in final form.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
